For purposes of this Privacy Policy, references to "we," "our," and "us" mean Northwest Mothers Milk Bank, an Oregon nonprofit.  We own and operate the website at https://www.donatemilk.org/ (the "Website").  We recently assumed the operations of Mother's Milk Bank of Montana, including its https://www.mothersmilkbankofmt.org/ website, so references to Website in this Privacy Policy also include https://www.mothersmilkbankofmt.org/. The Website is intended to provide you with
information about, and to facilitate, our safe collection and distribution of human donor
milk.  We also provide related education, advocacy, and research.

This Privacy Policy explains how and why we collect, use, and disclose personal information collected through the Website and its various webforms, fax, email, and phone, including by voicemail (all these methods are collectively referred to in this Privacy Policy as the "Website". If you do not agree with our policies and practices, your choice is to not use our Website. We reserve the right to change, modify, add, or remove portions of this Privacy Policy from time to time. We will not, however, retroactively change how we collect, use, or disclose personal information without your consent.  We will provide notice to you of any material changes through the Website or by other means as we deem appropriate before they take effect. Please check back periodically for any changes we may make to the Privacy Policy. Your continued use of the Website following the posting of changes to this Privacy Policy means that you accept these changes.

Finally, please note that this Privacy Policy applies only to our Website and other websites that display these terms.  It does not apply to any website, mobile app, service, or product that does not display or link to this Privacy Policy or that contains its own privacy terms.  Nor does this policy apply to information collected through our business relationships (that information is subject to separate agreements), in person, or to the extent information collected falls under our Notice of Privacy Practices (applicable to milk donors and recipients), which may be updated from time to time.

 

2. Personal Information We Collect About You

As noted above, our Website is primarily designed to provide you with information regarding, and to facilitate, our safe collection and distribution of human donor milk. But we also offer a variety of ancillary opportunities, goods, and services.  A brief overview of the information, opportunities, goods, and services we offer at the Website follows. 

 

You can:

  • Apply to be a donor, and donate milk;

  • Apply to be an outpatient recipient of donor milk;

  • Request milk on behalf of a hospital;

  • Coordinate a milk drop or pick up donor milk at one of our milk-distribution sites;

  • Request a pump rental;

  • Provide testimonials, including photos and text;

  • Apply for employment, volunteer, and internship opportunities;

  • Subscribe to our newsletter;

  • Register for one of our events, or an event co-hosted or sponsored by us;

  • Contact us using one of our webforms, or by phone, fax, or email;

  • Order supplies, including donor cards, informational brochures, and shipping materials;

  • Make a non-milk donation – such as a donation of money, stock, or cryptocurrency;

  • Request use of the community room at our headquarters;

  • Participate in our free, drop-in, informal breastfeeding support groups or classes; and

  • Purchase apparel in our online shop
     

We may collect information from you in connection with our provision of the Website and
the above-listed opportunities, goods, and services. This information is generally
provided directly by you – such as when you provide us with information through a
webform or other interactive features on the Website, or by phone, fax, or email.  The
personal information we may collect from you includes:
 

  • First and last name;

  • Date of birth

  • Email address;

  • Phone number;

  • Mailing address;

  • Health information and health-insurance information, including information about your medical history and medication/supplement use, physical condition, lifestyle information, and medical diagnosis and treatment;

  • Financial information;

  • Location (if you consent to location tracking while on the Website);

  • Education and employment history, including references (for job, internship, and volunteer applicants); and

  • Any other information you choose to provide in narrative forms or testimonials.

 
Given the nature of our goods and services, you may also provide some of the above
information for a child(ren).

We may also collect the IP address (or other unique online identifier) of all Website visitors, device IDs if the Website is accessed from a mobile device, and general information about the equipment you use to access the Website, your operating system and browser type, the times and dates of your interactions with the Website, details of your transactions through and interactions with the Website, and software event data.

Finally, we may collect certain information about you if you authorize a third party, such as your physician, to provide it to us, or if you interact with social-media platforms linked from the Website, such as Facebook, Instagram, YouTube, TikTok, LinkedIn, and X/Twitter, if you "tag" us (@nwmmb), use a hashtag we request, or "Like," "Follow," or otherwise interact with our page or profile on that platform.

3.  How We Collect Information

We may collect information:

  • Directly from you when you provide it, including (for example) by email, phone, fax, or using various webforms available on our Website, or when you make a monetary donation.

  • From third parties you authorize to provide us with information, such as your physician.

  • From social-media platforms linked from the Website, such as those listed above. 

  • Using cookies. Cookies are small files that are placed on your device when you visit the https://www.donatemilk.org/ and https://www.mothersmilkbankofmt.org/ sites.

We may share non-personally identifiable information, such as aggregated and
deidentified user statistics, with third parties without restriction.  We do not share your
personal information with third parties for third-party marketing purposes, or for any
other purpose other than as described in this Privacy Policy. Notwithstanding the
foregoing, we use Google Analytics and Google Ads, both of which are subject to
Google's privacy policies – and may involve sharing information collected via Google

We may share the information we have collected about you—including personal
information—as disclosed at the time you provide such information and in the following
circumstances:

Third Parties Providing Services on Our Behalf. We use third parties to host the Website and perform administrative, analytics, marketing, and communications services. Services these parties provide include hosting webforms (e.g., Jotform), payment processing (e.g., Give Lively), providing analytics for the https://www.donatemilk.org/ and https://www.mothersmilkbankofmt.org/ sites, serving advertisements to you, cloud storage, and sending our newsletter and marketing communications by email.  We may disclose your personal information to these companies so they can carry out these business purposes on our behalf.  Except with regard to Google (discussed below), these companies are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them.  Please also be aware that, if you encounter a third party's terms and conditions (e.g., Give Lively for donations and Zazzle for our online store, various social-media platforms when you are using those platforms) when using a feature of the Website, you will be subject to that party's terms and conditions; we therefore encourage you to review any such terms and conditions when encountered. Regarding analytics, we use Google Analytics. Google Analytics functionality involves cookies that collect information about your use of the https://www.donatemilk.org/ and https://www.mothersmilkbankofmt.org/ sites to help create reports and statistics on the performance of those sites. Analytics cookies collect information such as your IP address, type of device, operating system, referring URLs, country information, date and time of page visits, and which pages you visit the most. The information allows us to count our audience size, see the overall patterns of usage on the sites, help us record any difficulties you have with the sites, and show us whether our advertising is effective or not. We are not responsible for the practices employed by websites, social-media platforms, mobile applications, or services linked to or from the Website, including the information or content contained therein. Our Privacy Policy therefore does not apply to any such third-party websites, social-media platforms, mobile applications, or services:  you should review those third parties' policies and practices before using them.

Personal information is stored in operating environments that are not available to the public. Only those of our employees and agents who need access to personal information to do their jobs are allowed access, each having signed confidentiality agreements or otherwise subject to a duty of confidentiality.

While we make reasonable efforts to safeguard personal information once we receive it, no transmission of data over the Internet or any other public network can be guaranteed to be 100% secure. As a result, we cannot ensure or warrant the security of any information you transmit to us or information we transmit to you from the Website, and you assume all related risks. We generally retain personal information only for as long as is necessary for the purposes set out in this Privacy Policy. In certain cases, we may be required to continue to retain personal information to comply with applicable law or in connection with a legal claim.

Business Purpose. We collect and process personal information only when we have a business purpose to do so. Examples of these business purposes include (a) providing you with access to the Website and the information, opportunities, goods, and services provided through the Website; (b) providing you with up-to-date information about us and new features of the Website; (c) engaging third-party providers to deliver certain features of the Website and our goods and services; and (d) complying with record retention laws or other legal obligations.

Cross-Border Transfers. The Website is hosted on servers in the United States, and is intended for only people residing within the United States.  Any personal information you provide to us will be processed and stored on servers in the United States, the laws of which may be deemed by other countries to have inadequate data protection. If you nevertheless access or use the Website from outside the United States, you consent and continue to consent to the processing and storage of such data in the United States. We use safeguards to protect personal information in accordance with this Privacy Policy.

Do Not Track. Some browsers incorporate a "Do Not Track" (DNT) feature that, when turned on, signals to websites and online services that you do not want to be tracked. At this time, the Website does not respond to DNT signals.

Children Under 18. The Website is not intended for children under 18, and we do not knowingly collect personal information directly from children under the age of 18. We only collect information regarding children directly from parents or guardians. If you are under 18, please do not use the Website or submit any personal information through it. If you have reason to believe that a child under the age of 18 has directly provided their personal information to us through the Website, please contact us and we will delete that information.

If you choose not to provide personal information, you may be unable to access or use the Website or certain Website features, or to receive certain information, opportunities, goods, or services.

Your Privacy Rights. To request access to or correct or delete information submitted through the Website, or to opt out of advertising provided directly by us, you may submit a request – with "Opt-Out"in the subject line – to us by emailing info@nwmmb.org. Be sure to include your name, address, and/or email address so we can identify you (we will only use the information you provide for the purpose of responding to your request). If you only wish to unsubscribe from emails, you can click on the unsubscribe link at the bottom of the email you received. We will not discriminate against you for exercising your privacy rights.

Please note, however, that we may be unable to change or delete personal information if we believe it would violate any law or legal requirement or cause the information to be incorrect. In any event, we may ask you to verify your identity before responding to any request.

Specific State-Level Consumer Rights. Although our privacy practices generally align with the federal Health Insurance Portability and Accountability Act (“HIPAA”), some information we collect may not be deemed “protected health information” under HIPAA. We may therefore be subject to Washington’s My Health My Data Act (and other similar state laws) and are therefore providing a separate Consumer Health Data Privacy Policy. You may review that Policy to determine if it applies to you and, if so, exercise your rights. Various other states around the United States now have comprehensive privacy laws that apply to people who reside in those states. We are not currently subject to those other laws, however.  If that changes, we will update these terms to ensure we reflect any additional rights reserved under applicable laws. Those updates will be made available within this Privacy Policy, in accordance with applicable law.
